Please take a few minutes to review these Terms and Conditions. Your use of this website constitutes your agreement to these terms and conditions and to be bound by them.

Madal Bal Australia Pty Ltd (ABN 51 122 799 240) (“Madal Bal”) reserves the right to amend these terms and conditions with no prior warning to you. We therefore advise you to check these terms and conditions from time to time for such changes.

Placing Your Order

You may place an Order by filling in the Purchase Order Form on the Lemon Detox Diet website.

When you place your Order, we will issue you with an Order Number. This is the reference for your order and is confirmation that your order has been received by Madal Bal Australia Pty Ltd. We advise you to print out this confirmation of your order for your future reference.

By placing an Order, you make an offer to us to purchase the Products you have selected based on these Terms and Conditions.

Once your order is placed it will usually be processed within 2 days, however, Madal Bal Australia Pty Ltd reserves the right to process your order beyond this time frame should there be a shortage of supply of the Madal Bal Natural Tree Syrup™. Processing time can be affected by availability of product.

If we cannot process or accept your Order we will contact you by email or telephone.

Payment Methods and Processing

Madal Bal Australia Pty Ltd currently accepts Visa, MasterCard, Direct Deposits, Money Orders only. Cheques not accepted.

Payment processing will not begin until we receive all the information we need.

Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.

Business days are Monday through Friday, excluding NSW Public holidays.

We will send you a tax invoice along with the delivery of your Order. Your tax invoice is your proof of purchase.

Please Note:
• Debit cards cards have daily spending limits that may substantially delay the processing of your order.
• You may be required to provide further identification for additional security reference checks.

Supply Of Your Products

Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation.

Delivery of your Products

Delivery time takes up to 9 working days from the date your Order is processed or payment is received, unless otherwise stated on our website.

Madal Bal Australia Pty Ltd makes every effort to deliver your Product according to the estimated delivery times provided on the website. The estimated delivery times are in business days (Monday through Friday) excluding Public holidays.

Although every effort is made to send your Order according to the estimated delivery times provided, estimated delivery times may change due to changes in supply or circumstances beyond our control. If your Product has not arrived after the estimated delivery time, please contact us here.

We use a number of national courier companies (Fastway Couriers and Couriers Please) and Australia Post (for remote country areas & P.O boxes) for our delivery service. On rare occasions, despite their best efforts, a parcel may be delayed in the delivery process (which is out of the control of Madal Bal Australia Pty Ltd). We will always endeavour to work with our delivery partners and you to ensure prompt arrival of your product within the stated delivery time on the website, but this can not be guaranteed.

Unless otherwise agreed by us, we will deliver your Products to the address indicated on your Order Confirmation. If no-one is available to take delivery of your Products, our Post Office Courier will leave a card so you can pick-up your product from your local Post Office. Where delivery is by our couriers (Fastway Couriers or Couriers Please) service and no-one is available to take delivery, they will leave a card requesting you to telephone them to arrange a suitable time and date for delivery, this may incur an additional charge.

We will use our reasonable efforts to deliver your Products to you within the estimated delivery time indicated on your Order Confirmation; however, we do not guarantee that we will deliver within this time frame.

While we make every effort to ensure prompt and timely delivery, no responsibility can be accepted for late deliveries due to circumstances outside our control. Please note that once an item has left our premises, we no longer have control over it and are not responsible for it. Title and risk of loss to all Products will pass to you upon delivery to the courier. However, we guarantee to do our utmost to track the parcel and report the anticipated delivery time and date back to the customer.

All deliveries organised by Madal Bal Australia Pty Ltd on behalf of the customer are to kerb side or street level only, unless previously arranged with Madal Bal Australia Pty Ltd. If Madal Bal Australia Pty Ltd is not previously told of any stairs or other access issues preventing a smooth delivery, the transportation courier has right to refuse delivery upon arrival, as they will not be sufficiently equipped to deliver on site. This is the responsibility of the purchaser to correctly notify Madal Bal Australia Pty Ltd with all delivery access and information prior to. If this is the case and further charges occur, the customer will be liable to pay all extra charges as they have misinformed Madal Bal Australia Pty Ltd prior to the delivery occurrence.

If you have supplied a work address as the specified delivery address, we advise you to include your company/ business name, building name as well as the level/ suite number of your nominated address. This is to ensure and assist with timely delivery of your product.

Your Rights to Return a Product

No refunds are offered if you have changed your mind about the product, make an incorrect choice, or failed to verify and accurately provide information when placing an Order, unless otherwise approved by a Customer Service Manager.

Opened goods will under no circumstances be refunded.

If approved, we will refund by a cheque sent to your mailing address and will not include any postage and handling charges incurred for the original purchase of the product, or any charges incurred by you to send the unopened original product back to us.

For your security, please return your product with an insured courier and retain your receipt. Madal Bal Australia Pty Ltd are not responsible for products damaged or lost in transit.

Should a refund be approved you will receive a cheque for the cost of the product only.

Security

This information tells you about our Internet security and how you can check that our order pages are secure.

In compliance with our banks Merchant agreement, ALL credit card transactions made via this site, are manually authorised before shipping of goods.

Before PAYMENT information entered on our order page is transmitted across the internet, it is secured using industry standard SSL, which is proven as secure for online shopping and e-commerce.

Despite media paranoia about Internet security, this encryption method is actually more secure than providing your credit card number over the phone, something many of us do without hesitation.

There are several indicators of a secure web page.

The first is the https:// prefix on the URL. If this page is located within a frames environment you may wish to open the page in its own browser window to confirm for yourself that it is a secure page.

The second indicator of a secure page depends on your browser.

Old versions of Netscape display a blue bar at the top of the page, while newer versions display a key or padlock in the lower left hand corner of the screen. Our digital key, required for secure web page encryption was provided by GEOTrust. GEOTrust performs a comprehensive background check on any company before issuing a digital key.

From the file menu, select properties, then click on the security tab to bring up details of the digital ID.

Microsoft IE4 or later

Click on the gold padlock to bring up details of the digital ID.

Netscape Navigator 3

Click on the gold key in the lower left corner and Show Document Info on the Security Information page. Under Certificate, view our digital ID details.

Netscape Communicator 4 or later

Click on the gold padlock in the lower left hand corner and the View Certificate button on the Security Information page.

If you are still not comfortable sending your credit card details across the internet, you can order by phone or fax.

Madal Bal Australia Pty Ltd respects your privacy. We do not sell, rent or loan any identifiable information regarding our customers to any third party. Any information you give us is held with the utmost care and security.

Personal Information

Your name, address, telephone number and email address help Madal Bal Australia Pty Ltd to deliver your order on time to the correct location. A Customer Service Representative may contact you by telephone or email to resolve any questions we might have about your order.

Madal Bal Australia Pty Ltd will not reveal your personal information to any third party unless required to do so by law.

Secure Online Ordering

Madal Bal Australia Pty Ltd’s Purchase pages are secured by a GeoTrust certificate ensuring the best possible security for your private credit details. The certificate can be checked by clicking on the small padlock that appears in the right hand side of the top bar of your web browser(IE7) when you open the Purchase page.

Your credit card details are deleted from our system once your order has been processed.

GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws in force in the State of New South Wales, Australia, without giving effect to any principles of conflicts of law.

GENERAL

If any provision of this agreement is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
